Authorization of activity in the field of electronic communications
The activity in the field of electronic communications shall be carried out on the basis of authorization of such activity.
Authorization means the registration of activity of a natural person or legal entity providing public electronic communications networks and facilities and/or electronic communications service. The registration is carried out by the Georgian National Communications Commission.
Any manufacturing entity, as well as any non-manufacturing legal entity providing electronic communications networks and/or electronic communications service shall pass the registration.
The entity wishing registration of the provision of electronic communications networks and facilities and/or electronic communications service shall submit a declaration to the Commission.
The declaration shall indicate:
a) In case of individual entrepreneur-first name, last name, birth place and date, data on registration in the Entrepreneurial Register, working and home addresses;
b) In case of legal entity-mark name, organizational-legal form, legal address, data on registration in the Entrepreneurial Register, first name and last name of legal representative;
c) Types of activities and/or services, authorization of which is demanded by individual entrepreneur or legal entity;
d) Short description of network and/or service.
Copies of Charter and founding documentation shall be attached to the declaration, as well as extract from the State Register and a copy of the relevant document identifying the entity.
Within 10 working days after receiving the declaration, the Commission shall carry out authorization of the provision of electronic communications networks and facilities and/or electronic communications services, by means of registration in the Register of the Authorized Entities.
In case the submitted declaration and/or attached documentation is incomplete, by means of decision, the Commission shall determine a period to allow the entity wishing authorization to submit the missing documentation. In case, the entity wishing authorization does not submit the complete documentation within the determined period, the authorization will not be carried out. If, within 10 working days after receiving the declaration, the Commission does not determines the period for submitting the missing documentation by the entity wishing authorization, the entity will be considered as authorized.
Within 7 working days after authorization, the Commission shall issue Certificate of Authorization.
Authorization of activity in the field of electronic communications shall be carried out for an unlimited period of time.
The entity is entitled to begin its activity from the day of registration in the Register of the Authorized Entities.
